Some of my syntax isnt working

Ok here is the problem. When I have it setup in our servers for
teamkilling it is set g_teamkillkick "5" but it does not kick anyone after they tk 5 times.

How can we resolve?

This may be naive of me, but don't you need a mod installed to do that? Like PRM Realism or Merciless Blood mod?

Call of Duty does not, by default, have tk protection (i.e. kick them). You need the use of a mod (PRM, CoDaM, etc.), or, thanks to PunkBuster, you can use it - pb_sv_scorekick
