View Full Version : Microsoft sued over XBL outages over holiday week(s)

Just spotted this little gem while grabbing some breakfast at the airport, before heading through security.
Three Texas residents filed a lawsuit Friday on behalf of themselves and others who have had trouble connecting to Xbox Live in recent weeks.
While this does not directly impact us PC admins/customers/clients. I can't seems to overlook the problems we've recently had with Activsiion's very successful CoD4 and it's master servers. Now granted we don't pay a monthly subscription (sic) for our online pleasures, however it still impacts us and the game we paid for. I wounder, if this lawsuit is successful, will it have any impact or a foundation for a PC type lawsuit in the future?

PC devs and publishers need to be more aware of these types of issues, not to mention when customers pay a large monthly fee for their dedicated servers to support these games we buy. I wonder if the problems IW is having with customers getting listed in the in game browser could be another avenue of attack for these types of lawsuits. I know there's a lot of speculation on my part but if this lawsuit is successful, I wonder if we may see more in the future?
In the suit, the plaintiffs allege that Microsoft should have known strong holiday sales would tax its servers. "Microsoft knew the increase in subscriptions would increase game-play on its servers, yet failed to provide adequate access and service to Xbox Live and its subscribe
If i was Activision I know I would be keeping a close eye on this lawsuit, if I was EA I would have nothing to worry about.

I heard that MS was going to give the XBox live people a free game due to this. Guess a months credit isn't an option lol

If the case sets a presedence we all know who is really going to pay don't we? As RD said I could speculate all month on the impact this could have on the PC realm of games.

Just a few off the top off my head.

1) Lawsuit gets won by Plaintiffs = higher PC gameprices to recoup lost revenues and pay Legal fee's plus save money for the next suit.

2) Pay to play for those lobbies instead of being free.

3) And a good one. Our level of uptime expectation would increase along with updates and lobby fixes ASAP.

Offering a free XBLA game for the outages, its a start.

Didn't effect me at all but I will take the free game :D, I usually don't play online VIA XB360 anyways.

I think the biggest issue right now is a two part issue for IW/Activision

Call of Duty 4 is so popular right now that Activision's Master servers can't keep up with demand, which is close to the complaint filed in Microsoft's direction.

The next and what I think is a bigger problem is servers not being listed via the in game list. This is not a new issue and needs to be address ASAP!

HIS-Mother, lets hope these "costs" if this ever happens, are passed on to the console games and not us "PC" gamers :hand: -- j/k I'm just kidding......

Not had a problem online with my PS3, but then Xbox is a microshit product and you get what you pay for.

Someone should tell these guys that are sueing to save there money and just buy a PS3 and a PC, it would save them alot of cash, becuase Microsoft could bury them in legal crap for the next 20 years.
